Informed Consent and Acknowledgement
Declaration and parental consent for participants under 18 years old:
I am the parent/guardian of the minor named in this application and am authorised to make this declaration and give this consent on their behalf.
I certify that the statements made regarding the minor’s psychological and physical condition and any previous illness/es are true and accurate.
I understand that the minor must not use any drug which is considered illegal.
I authorise any hospital or medical practitioner to furnish information relevant to the minor’s medical condition to a medical assessor to determine competition fitness.
I acknowledge that driver training can be dangerous and agree that Fifth Gear Motoring shall not be under any liability whatsoever for any death or bodily injury, loss, or damage which the minor may suffer, howsoever such death or bodily injury, loss or damage is caused, by negligence or otherwise when participating/competing in any Fifth Gear Motoring event.
I agree that the minor shall abide at all times whilst undertaking said driving course to be subject to the directions of the servants and agents of Fifth Gear Motoring in all respects.
I declare and confirm that the participant is physically fit and have no conditions or injuries that could be affected by their participation in the said course. I acknowledge that it is a fundamental condition of their participation in the said course that I have notified Fifth Gear Motoring and or its servants of any existing medical condition which may affect my participation in the said course and which may exacerbate or deteriorate as a result of injury sustained during the said course.
I declare and confirm that general photos of the activities be undertaken may or may not include the driver. Fifth Gear reserve the right to use these photos for promotional/marketing use.
Parental consent for participants under 18 years old, I as parent/guardian of the Applicant hereby give permission for the driver to participate. In doing so I acknowledge that driving can be dangerous and agree that Fifth Gear Motoring shall not be under any liability whatsoever for any death or bodily injury, loss or damage which may be sustained or incurred by the participant, howsoever such death or bodily injury, loss or damage is caused, by negligence or otherwise during a Fifth Gear Motoring event.
I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT OR COMPLETING PAYMENT, AND HAVE SIGNED OR COMPLETED PAYMENT FOR IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT, ASSURANCE OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE AND OR COMPLETION OF PAYMENT FOR THE EVENT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW.
